The Coordination Office for the Implementation of Environmental Liability (COIEL), in accordance with the provisions of P.D. 100/2014 (Official Gazette A 167) "Organization of the Ministry of Environment, Energy and Climate Change", comes under the Inspectorate of Environment, Building, Energy and Mines. The COIEL is competent, according to the provisions of P.D. 148/2009 (Official Gazette A 190): "Environmental liability for the prevention and remedying of environmental damage - Compliance with Directive 2004/35/EC of the European Parliament and of the Council of the 21st of April 2004" for the following:
As a competent authority, COIEL recommends to the Minister of Environment and Energy the undertaking of action for the prevention and/or remediation restoration, where the damage or imminent threat of damage are affecting natural resources or services of national significance, the protection and/or management of which are under the responsibility of a public authority, or when the affected natural recipients or services that extend the administrative boundaries of one Region, or the territory of other neighboring Member-States. For damage or imminent threat of damage affecting natural resources or services that are not covered in the above mentioned cases, responsibility as a competent authority will be undertaken by the relevant Decentralized Administration through PEAPZ.
Also, in the framework of the responsibilities of the COIEL, it is foreseen to cooperate with the competent authorities of other Member-States and the European Commission for the implementation of environmental liability at a transboundary level, to cooperate with several scientific institutions for gathering scientific or other information on prevention and remedying issues of environmental damage, and to provide an opinion to the Minister of Environment and Energy for the implementation of the financial security (Article 14 of Presidential Decree 148/2009).
