The Observatories will be managed from one lawyer each, empowered within the project’s frame to search the national environmental legislation ruling NATURA 2000 protected areas on Crete and jurisprudence of first and second instance courts of Crete.

Every four months, the lawyer is addressed to check and register legislation, ministerial or administrative decisions, acts of local governments and public contracts referring to direct or indirect environmental management of the Cretan NATURA 2000 protected natural habitats. The registrations note:

  • the publication in the Government Gazette (F.E.K.)
  • a short summary
  • the possible impacts on the NATURA 2000 area

Every four months, the lawyer checks and registers the environmental degradation cases taking place within the NATURA 2000 protected areas. The registration takes under consideration the protection of personal data.

West Crete Observatory

The west Crete Observatory is competent for controlling the jurisprudence  of the first instance Courts of Chania and Rethimno, the jurisprudence  of the second instance Court of west Crete which sits in Chania and the legislation ruling the 29 NATURA 2000 protected habitats of west Crete.

East Crete Observatory

The east Crete Observatory is competent for controlling the jurisprudence of the first instance Courts of Heraklion and Neapolis, the jurisprudence of the second instance Court of East Crete which sits in Heraklion and the legislation ruling the 25 NATURA 2000 protected habitats of east Crete.

Information - Legal reservation

The LIFE THEMIS Law Observatories introduce the geoinformation map as a new technological tool in the field of crime prevention and repression. This is an extremely difficult task, the success of which depends on numerous factors, such as the recording rate and timing of the Observatory partners, as well as on imprecise factors such as the access to data and the speed of response of the stakeholders. The dynamic nature of the research, the constant updating of the data on which LIFE THEMIS statistics are based, necessitates the explanations and reservations beneath.

• The assignment of the research to the Bar Associations of Heraklion and Chania was based on the large number of cases processed by the respective Courts of First Instance of Heraklion and Chania.

• The distribution of cases between Eastern and Western Crete is managerial. The large volume of data is grouped at their origin, the Courts of First Instance in which they are collected (Chania, Rethymnon, Heraklion and Lasithi). The results are exported for the island in total.

• The purpose of recording and statistical analysis is to provide, a better audits planning, a qualitatively and quantitatively assess of the environmental acts and penalties, the forecast of criminal offenses commission, the strengthening of interdepartmental cooperation between law enforcement authorities and the awareness raising among  local communities.

• Environmental crimes and offenses are posted without reference to personal data of the person accused under pre-trial investigation / or the offender. To ensure the confidentiality and protection of the perpetrators' personal data, a special research permission has been obtained from the competent Data Protection Authority.

LIFE THEMIS Law Observatories gather, analyze and publish data and meta-data under the reservation, that cases of prosecution registered in local prosecutor's offices are just a fraction of reality, only a part of the actual number of environmental degradation cases. The recording is made with the obvious reservation of the effectiveness of the prosecution. More pro-active services will show higher rates in specific areas, without necessarily reflecting the real percentage of the respective crimes. A coherent picture of environmental degradation in Crete will be feasible at the end of the program when all the recorded cases for the years 2010-2020 have been explored.
